Facts in brief:
The Defendant designs and builds residential homes in Auckland. It was building four three-level units and engaged a project manager to manage the site and a scaffolder to erect scaffolding. A worker used the scaffold to paint the fascia when three unsecured scaffold planks uplifted causing him to fall to the ground. He suffered a broken arm, dislocated wrist and cuts and bruises.
