The defendant company was engaged to arrange and complete all concrete work on sites for Hobsonville School – namely a primary and secondary school. The defendant company engaged another company to arrange, install and erect the concrete precast panels for the theatre building.
On 6 December 2012 at approximately 12.15pm a wind storm struck the Hobsonville Schools project site. During the storm, concrete precast panels collapsed.
A number of precast panels collapsed onto a truck at the work site, killing its occupant and two others who were sheltering by the truck at the time. A fourth person was able to climb out of the cab of the truck and suffered injury to his head as a result.
